We can assist you at all stages of this process, including negotiation and preparation of the correct documentation to ensure your agreement is legally binding and enforceable.

We understand that going through divorce or separation is an emotionally taxing and difficult time. With a lot to consider, having the right support to navigate the confusion and uncertainty makes all the difference.

For a divorce to be granted, the Family Court must be satisfied that you have been separated from a period of at least 12 months preceding the filing of a Divorce Application and that the arrangements for any children are proper. An Application for Divorce can be filed by either party to a marriage or both parties jointly.

Our experienced family lawyers will guide you in ensuring all necessary steps are taken regarding the division of assets, maintenance, parenting, child support and other factors. We can assist at all stages of this process, including preparation of the Application for Divorce or responding to any application made.

We can also assist with advice and applications in relation to declarations relating to a marriage, including declarations of nullity or as to the validity of a marriage, divorce, or annulment of marriage.

We will take time to explain the various systems and processes, including the options open to you and the most efficient way to achieve those.

If the other party is being unreasonable or uncommunicative, we can help to resolve disputes in a cost-effective way through mediation, arbitration, or negotiation.

If you are concerned for your safety, your children’s safety, or both, we can work with the court to issue orders for your personal protection.

Every situation is different, and our team works with you to develop a strategy that suits your personal needs, giving you clarity for the path ahead.

Following the breakdown of a marriage or de facto relationship, dividing up property and having certainty around your financial future is important to both parties and a vital step in helping parties move on with your life. While some financial matters can be straight forward, the division of property and other assets can be extremely complex. It is important in financial matters for you to seek prompt, practical and professional legal advice so you can make informed decisions about your future.

We can put your mind at ease by advising you on what entitlements you can likely expect, with a view to achieving an appropriate settlement quickly and efficiently.

We can assist at all stages of a financial matter, including providing advice, and offer a range of options to help both parties come to an agreement, including negotiated settlements, and mediation both before and after court proceedings have commenced. Following an agreement, we will advise you on the most appropriate and cost-effective next steps to formalise matters and ensure financial security.

Should you be unable to reach a resolution, we can also assist in commencing court proceedings and representing you throughout court proceedings, up to and including Trial.

Going through a divorce or separation is always a difficult time, but it can be especially hard if there are children involved. After any separation, determining who a child should live with and what time they spend with the other parent can be stressful. Between the day-to-day care of your children, any medical requirements, extracurricular activities, milestone events and more, you and your ex-partner will likely cross paths regularly.

Even in the most amicable circumstances, advice is usually required to ensure the most appropriate arrangements are put in place for your children. Through negotiation, we aim to work with you and your ex-partner to maintain an amicable relationship and move forward with your children’s best interests at heart.

Our family lawyers are highly experienced in dealing with all aspects of child-related matters, including parental responsibility and living arrangements, child support payments, and location and recovery orders.

We can assist at all stages of any parenting matter, including providing initial advice and in any mediation or family dispute resolution before or after court proceedings are commenced. We use effective mediation techniques that encourage resolution in a cost-effective and time efficient way.

Should you be unable to resolve matters at family mediation, we can also provide support in dealing with matters in the Family Court, including representation throughout court proceedings, up to and including Trial.
